The California Consumer Privacy Act creates numerous obligations for businesses that operate in California and collect personal information about California residents. The Act provides Californians with number of key rights and protections connected to their personal data.

The Act provides consumers with the right to:

  • know what personal data is being collected about them;
  • know how that information is used or shared;
  • delete personal information collected from them;
  • to opt-out of the sale or sharing of their personal information; and
  • non-discrimination for the exercise of their rights under the act.

The CCPA applies to for-profit businesses that do business in California and meet any of the following:

  • Have a gross annual revenue of over $25m;
  • Buy, sell, or share the personal information of 100,000 or more California residents or households; or
  • Derive 50% or more of their annual revenue from selling California residents’ personal information.

Subisidiary and affiliate businesses will be in scope of the CCPA as revised if they share common branding (name, service mark or trademark).
